Most people only need a notary a few times in their lives, so it’s no surprise that the process is surrounded by myths. Here are eight we hear regularly, and the facts behind them.

1. “A notary confirms that my document is true.”

Not quite. A commissioner or notary confirms who signed or swore the document and that it was sworn or declared properly. The truth of the contents is the responsibility of the person making the statement.

2. “I should sign it before I arrive to save time.”

Please don’t. Affidavits and statutory declarations must be signed in front of the commissioner. A document signed in advance may need to be redone.

3. “A notary can give me legal advice.”

Commissioners are not permitted to act as lawyers or give legal advice. We can explain our process, but not what your document should say or whether it’s right for your situation.

4. “Any photocopy can be notarized.”

To certify a true copy, we need to see the original document.

5. “Notary and commissioner are the same thing.”

They overlap, but a notary public can do more, including certifying copies and attesting signatures. See our guide to notary vs. commissioner.

6. “Someone else can sign on my behalf if I send my ID.”

No. The person making the statement must appear, prove their identity and sign personally.

7. “Everything can be done online now.”

Ontario does allow some remote commissioning, but not every document or receiving organization accepts it. Read our post on online commissioning in Ontario before you choose.

8. “A notarized document is automatically accepted abroad.”

Many countries require additional steps, such as an apostille. Always check the destination country’s requirements first.
