If you are applying to Immigration, Refugees and Citizenship Canada (IRCC) with a common-law partner, you will likely come across form IMM 5409, the Statutory Declaration of Common-Law Union. Because it is a statutory declaration, it must be solemnly declared before an authorized official. Here is what to know before you book.

What the IMM 5409 is for

IRCC uses the IMM 5409 to confirm that two people are in a common-law relationship. It is commonly used in family sponsorship applications and in other applications where a common-law partner is included. IRCC’s program guidance generally treats a common-law partner as someone you have lived with in a conjugal relationship for at least one year, but always check the instructions for your specific application.

Who needs to be at the appointment

Both partners. The form must be completed and signed by both people in the relationship, with handwritten signatures, in front of the official who administers the declaration. If one partner cannot attend, contact us before booking so we can discuss options.

Before you arrive

  • Download the current version of the form directly from IRCC’s website.
  • Complete the information fields, but do not sign.
  • Bring valid government-issued photo ID for each partner.
  • Double-check dates and names against your other application documents. Inconsistencies can cause delays with IRCC.

At your appointment

We will confirm both partners’ identities, have each of you solemnly declare that the contents are true, witness your signatures, then complete the official’s section of the form and apply our stamp. We do not review your immigration application or advise on eligibility; for that, please speak with a lawyer or a licensed immigration consultant.
