MANDATORY DOCUMENTS REQUIRED BY SERVICEONTARIO

To successfully register a vehicle transfer under a family tax exemption, the recipient must visit a ServiceOntario location within six days of the transfer and physically present the following criteria:

  • Vehicle Ownership Permit: The original green registration paper with the “Application for Transfer” portion on the back fully completed and signed by the donor.

  • Proof of Ontario Auto Insurance: A valid pink liability card showing the vehicle is fully insured under the recipient’s name (the donor’s insurance does not transfer).

  • Ontario Driver’s Licence: Valid photo identification for the recipient registering the vehicle.

     
  • Sworn Statement for a Family Gift (Form 1157E): The official Ministry of Finance form, which must be physically or digitally signed and stamped by an authorized Commissioner of Oaths or Notary Public.

  • Safety Standards Certificate (SSC): A certificate from a licensed mechanic showing the car is roadworthy.  

  • Crucial Legal Exemption: Vehicle transfers strictly between legal or common-law spouses are completely exempt from requiring a Safety Standards Certificate, provided a dual-purpose “Spouse Declaration / Plate Transfer Declaration” form is filed concurrently. All other family transfers (e.g., parent-to-child or sibling-to-sibling) still require a valid safety certificate to put plates on the road.

WHAT IS THE FAMILY GIFT SWORN STATEMENT (FORM 1157E)?

The Sworn Statement for a Family Gift of a Used Motor Vehicle in Ontario (Form 1157E) is a legal affidavit. Both the person giving the car (the Donor) and the person receiving the car (the Recipient) must state under oath that:

1.They hold a legally recognized family relationship.

2.The vehicle is being transferred entirely as a gift for zero financial compensation or consideration.

3.The specific vehicle has not been transferred on a tax-exempt gift basis within the immediately preceding 12-month period (the province strictly limits this tax break to one transfer per vehicle per year).

Because this is an official declaration under the Retail Sales Tax Act, making a false or deceptive statement to evade tax is a serious provincial offence that carries heavy financial audits, fines, or imprisonment. This is why the document must be commissioned by an authorized official before ServiceOntario will accept it.

WHO EXACTLY QUALIFIES AS "FAMILY" FOR THE TAX BREAK?

ServiceOntario enforces explicit boundaries regarding who qualifies for a tax-free vehicle transfer. The exemption only applies if the donor and recipient match one of these specific relationships listed on Form 1157E:

-Spouse (including legally recognizedcommon-law partners)
-Parent / Step-Parent
-Child / Step-Child
-Sibling / Half-Sibling / Adopted Sibling
-Grandparent / Step-Grandparent
-Grandchild / Step-Grandchild

⚠️ Non-Qualifying Relationships: Aunts, uncles, cousins, nieces, nephews, and unmarried partners who do not meet the legal definition of common-law cannot use the family gift exemption. These transfers are treated as regular private sales, and tax will be calculated based on the vehicle's wholesale value.
